    Supreme Court Declines Case Against Organizer Facing Civil Damages w/ Movement Lawyer Maggie Ellinger-Locke (G&R 287)

    This week, the U.S. Supreme Court declined to hear McKesson v. Doe. The case involves a police officer injured during a Black Lives Matter protest after the police murder of Alton Sterling in Baton Rouge, La in 2016. The injured police officer sued the organizer DeRay McKesson for damages. Last year, the US Court of Appeals for the 5th Circuit sided with the officer. The Supreme Court, for a second time, declined to hear the case.

    The impact of the Supreme Court's decision to decline to hear the case is potentially devastating for organizers of mass protests.



    In our latest, Scott talks with movement lawyer Maggie Ellinger-Locke about the case and the precedent it may be setting up.

    Maggie Ellinger-Locke, she/her, is a movement lawyer based in the Washington DC area, living on the stolen land of the Anacostan and Piscataway peoples. She works for the Thurgood Marshall Civil Rights Center at Howard University School of Law, where she helps train the next generation of movement lawyers. Previously she worked as a staff attorney at Greenpeace USA, and has also worked in public policy and private practice. She is currently co-chair of the DC chapter of the National Lawyers Guild.

    Forest defenders have launched a tree sit to stop old growth logging on federal Bureau of Land Management land in Southern Oregon. Community members are opposing the Poor Windy timber sale, which targets thousands of acres of mature and old growth forest.

    Scott gets an update from two forest defenders fighting the timber sale. They talk about the campaign, community support for the tree-sit and how forest defense is climate defense.

    We get into the anniversary of the publishing of "The Grapes of Wrath" and its significance on America and the American Left.

    We discuss how your tax dollars are subsidizing war profiteers like Lockheed Martin and keeping the war effort in Gaza going while paying for healthcare and public education in Israel. (Meanwhile America's masses are left to fend for themselves.) Scott also talks about a recent direct action at a Lockheed Martin facility in Sunnyvale, CA and the violence perpetrated by the company's employees when they were blocked from parking their cars in the company parking lot.

    We also discuss O.J. Simpson's legacy on race and politics in America, and NPR's "liberal bias" (and its discontents).

    Bob had a great conversation w/ Mike Elk of Payday Report, a frequent G&R guest. They spent most of the time discussing the current UAW unionization drive in Chattanooga, how this election is different than previous failed votes in 2014 and 2019, and the prospects for labor in the coming months. They also discussed his time in Brazil, and the challenges Lula faces. And finally, Mike, who was always wary of Fetterman, politely declines an "I told you so" moment but lays out why the junior senator from Pennsylvania isn't really a progressive.

I can’t recommend Green & Red enough. A real diversity of topics, always interesting guests and Scott & Bob really know their stuff.
